Rape Defense Attorney in Alexandria, VA

Former Prosecutors & Public Defenders Defending Rape Charges in Alexandria

A rape charge under Virginia law carries consequences that begin the moment an accusation is made. Reputation, employment, and family stability are all at risk before a single day in court. The sentencing range under Virginia Code 18.2-61 runs from five years to life in prison. Facing that kind of exposure, the defense attorney you retain matters enormously, and retaining one early, including during an active police investigation before charges are formally filed, can shape what evidence is preserved and what rights are protected.

King, Campbell, Poretz, and Mitchell handles rape and sex crime defense in both Alexandria Circuit Court and federal court. Our attorneys include former prosecutors and former public defenders, which means we understand firsthand how the Commonwealth assembles these cases. That background informs exactly where and how a defense challenge is most likely to matter. Since 2008, we’ve represented clients throughout Northern Virginia, bringing a collaborative team approach and direct attorney access to every case.

If you or someone you know is facing a rape charge or is under investigation in Alexandria, contact King, Campbell, Poretz, and Mitchell today at (703) 468-8557. Early intervention can make a critical difference in protecting your rights and building a strong defense.

Virginia Rape Law: What the Charge Actually Means

Virginia Code 18.2-61 defines rape as sexual intercourse committed against the victim’s will by force, threat, or intimidation, or when the victim is mentally incapacitated or physically helpless. The Commonwealth must prove each element beyond a reasonable doubt. For most convictions, the sentencing range is five years to life in prison. When the alleged victim is under 13 and the accused is 18 or older, the statute imposes a mandatory life sentence.

Rape allegations frequently arrive alongside related charges. Two of the most common are forcible sodomy under Virginia Code 18.2-67.1, which involves oral or anal sex committed by force, threat, or intimidation and carries the same five-years-to-life sentencing range, and aggravated sexual battery under Virginia Code 18.2-67.3, which carries a sentence of one to twenty years and a fine of up to $100,000. A conviction on any of these offenses typically triggers registration on the Virginia Sex Offender and Crimes Against Minors Registry under Va. Code 9.1-900, with requirements the legislature has repeatedly expanded over the years.

Where Alexandria Cases Are Tried

Rape charges in Alexandria are felony matters handled in the Alexandria Circuit Court, part of the 18th Judicial Circuit. The Alexandria Commonwealth’s Attorney’s Office pursues approximately 1,300 felony cases annually in that court. When an alleged offense occurs on federal property in the area, such as the George Washington Parkway, charges may instead be brought in federal court at the Albert V. Bryan United States Courthouse in Alexandria. We handle cases in both venues.

Defense Strategies in Alexandria Rape Cases

Rape cases are rarely straightforward. The defense strategy depends entirely on the specific facts, but several legal frameworks are consistently relevant in Virginia courts.

Consent & the State’s Burden

Consent is a recognized defense under Virginia law. The prosecution bears the burden of proving the act was committed without consent, through force, threat, intimidation, or the victim’s incapacity. In cases involving voluntary intoxication, the defense may examine whether the complainant retained the capacity to consent. Cases involving alleged drugging present a different legal framework, and those distinctions matter when building a defense.

Virginia’s Rape Shield Statute

Virginia Code 18.2-67.7 generally prohibits evidence of the alleged victim’s prior sexual history. The statute does permit exceptions: evidence that provides an alternative explanation for physical evidence, evidence of prior sexual conduct between the accused and the alleged victim that is relevant to consent, and evidence that the alleged victim had a motive to fabricate the allegations. Knowing when and how to invoke those exceptions is a skill built from courtroom experience with these specific charges.

Independent Investigation & Evidence Review

A thorough defense involves more than reviewing the prosecution’s file. We conduct independent investigations that include analysis of digital communications, text messages, social media records, emails, and surveillance footage. DNA and medical experts may be retained when the physical evidence warrants it. Careful cross-examination of inconsistencies in the complainant’s account is often where the defense gains ground. False allegations can arise from vindictiveness, a desire to conceal infidelity, or a misperception of events involving alcohol or drugs, and identifying what may have motivated an allegation is a core part of how we build each defense.
