  • Knowledge and intent: Prosecutors must prove the mental state required by the charged statute, not merely a person’s presence or association with others.

Searches, Warrants, & Statements

Search and seizure issues may determine whether evidence can be used in court. A suppression motion asks the court to exclude evidence obtained in violation of constitutional or procedural requirements.

Physical evidence may also require a review of laboratory results and chain of custody: the documented path showing who collected, handled, stored, and tested an item. Gaps or disputes don’t automatically decide a case, but they may affect the admissibility or weight of the evidence.

How Federal Sentencing Exposure Is Assessed

Potential sentencing exposure depends on the facts of the case. Drug type and quantity, prior convictions, criminal history, the person’s alleged role, firearm or injury allegations, and relevant conduct can all affect the analysis. Relevant conduct generally includes acts connected to the offense that a court may consider when calculating the advisory United States Sentencing Guidelines.

Some statutes carry mandatory minimum sentences when specified facts are established. Safety-valve eligibility may allow a qualifying defendant to avoid certain drug-related mandatory minimums, but it depends on statutory requirements and the individual circumstances. A meaningful assessment requires more than the name of the charge.
