Uncontested Divorce in Northern Virginia

Resolve Every Term Before Filing an Uncontested Virginia Divorce

An uncontested divorce can proceed on agreed terms only when both spouses have resolved every material issue. At King, Campbell, Poretz, and Mitchell, we represent one spouse and address property division, financial support, and child-related matters. If complete agreement isn’t possible, we also handle contested divorces.

Our family law services include divorce, Property Settlement Agreements, child support, and child custody and visitation. When a limited number of terms remain unresolved, we use mediation to pursue an agreement that reflects our client’s needs and family goals.

Requirements for an Uncontested Divorce in Northern Virginia

Virginia generally requires at least one spouse to have lived in the state for six months before filing. A no-fault divorce also requires the spouses to live separate and apart continuously for the applicable separation period.

The usual separation period is one year. It may be reduced to six months when the spouses have no minor children together and have signed a written separation agreement resolving every issue. Because the shorter period depends on both conditions, an informal understanding isn’t sufficient.

Our guidance indicates that an uncontested case can typically be finalized within two to six months, although the circumstances and court procedures affect timing. That estimate is separate from the required separation period before filing. A contested divorce can take several months to more than a year when issues remain in dispute.

What Your Divorce Agreement Should Cover

A Property Settlement Agreement is a legally binding contract that states how the spouses will divide marital property. It allows them to distribute assets and debts outside court rather than asking a judge to decide those terms.

Depending on the family’s circumstances, a complete agreement can address:

  • Property and debt division
  • Spousal support and other financial obligations
  • Child support
  • Child custody and visitation

Clear written provisions reduce uncertainty about each spouse’s responsibilities after the marriage ends. Once the court approves the agreement, it becomes part of the final divorce decree and carries legal effect.

From Filing to the Final Divorce Decree

The general process includes filing a Complaint for Divorce, serving the other spouse, allowing the required response period, resolving any outstanding issues, and obtaining a final divorce decree. An uncontested filing still requires the appropriate legal documents and court approval.

Agreement on most issues isn’t enough to proceed as fully uncontested. The spouses must first resolve any remaining disagreements, often through direct negotiation or mediation. We advise clients to resolve issues outside court when possible because mediation can reduce conflict and shape terms around a family’s needs.

If the spouses can’t reach complete agreement, the case may need to proceed as contested. We provide assertive court representation when settlement isn’t possible while continuing to evaluate opportunities for a practical resolution.

When an Uncontested Divorce Needs Additional Attention

Even when spouses agree, documentation or financial questions may require careful treatment. Virginia divorces based on fault grounds generally require corroborating evidence, though a 2021 law change removed that requirement for most no-fault separation cases like an uncontested divorce. Even so, documentation or a witness with personal knowledge of the separation can still help if any detail is disputed.

Spouses may live separate and apart under the same roof, but they must be able to demonstrate separate living arrangements and finances and show that they no longer presented themselves as a couple. Whether the available evidence satisfies that standard depends on the facts of the separation.

Financial issues that may require closer review include:

  • Asset and debt division: The agreement should identify what’s being allocated and state who receives or assumes each item.
  • Spousal support: Relevant considerations can include the marriage’s duration, each person’s earning capacity, contributions to the marriage, standard of living, and the parties’ age and health.
  • Retirement benefits: Dividing a 401(k) or pension typically requires a separate Qualified Domestic Relations Order, which directs a retirement plan to allocate benefits between spouses.

Legal Fees & Final Court Approval

Legal fees depend on the scope of the work, how complete the existing agreement is, and whether additional negotiation is necessary. Cases involving children, financial support, or substantial assets can require more attention even when both spouses intend to avoid contested proceedings.

An uncontested divorce isn’t final merely because the spouses have signed an agreement. The required documents must be filed, and the court must enter a final divorce decree. Whether a court appearance is necessary depends on the procedures used to complete the case and can’t be determined from its uncontested status alone.
